Gule Sheikh Twaha V Uganda Criminal Appeal No. 491 Of 2014 In The Court Of Appeal Uganda;

This was a case where the Appellant was convicted of murder Contrary to Section 180 & 189 of the Penal Code Act and sentenced to life imprisonment by His Lordship Masalu Musene in a Judgement delivered on the 5th June 2014 in the High Court of Nakawa.

The Appellant appealed against the sentencing and conviction stating that the trial Court passed a sentence basing on a repudiated confession made by the Appellant.

The Justices of the Court of Appeal applied the law on confessions and held that a trial Court can accept any confession which has been retracted or repudiated with caution and must before founding a conviction on such a confession , be fully satisfied in all circumstances of the case that the confession is true. In this case, the Trial Court accepted the said repudiated confession with caution.

The Justices of the court of appeal therefore upheld the sentence and the conviction.
