Case Brief

Introduction
The petition was brought under Article 137(1) & (3)(a) of the Constitution of Uganda 1995 and Rule 3(1), (2), (5) and 8(1) of the Constitutional Court (Petition and References) Rules S.I No. 91 of 2005.The petition challenges actions of the Respondent of forcefully surveying and demarcating land in Amuru District; forcefully acquiring the said land for the use and benefit of a private entity; and purporting to provide compensation for the forcefully acquired lands.

Background

The petition challenges the actions of the Respondent as being inconsistent with and/or in contravention of the proprietary rights to the lands held as customary tenure by the local communities in Amuru District guaranteed under Article 26(1) & (2) and 237 (1) & (3) (a) of the Constitution and having under-taken in a manner that flouts the law and procedure and therefore, is consistent with and/or in contravention of Article 26(1) & (2) of the Constitution.
